Please read this document carefully. It is constituted as the Terms and Conditions of Use that regulate access to the services offered by Net4Things S.L (“we” or “Net4things” hereinafter).

The registration and use of the services offered implies the express and unreserved acceptance of all the terms of this Legal Notice, having the same validity and effectiveness as any contract written and signed for this purpose. Its observance and compliance will be enforceable with respect to any person who accesses or uses the services. If you do not agree with the exposed terms, do not register or use the services.

1. Introduction and company data
   
   

   Net4Things S.L. registered as a company in Spain with CIF B83746107 and located at Calle Monte Esquinza, nº 26 – 1º izqda. – 28010 Madrid. Net4Things S.L. (“we” or “Net4things” hereinafter) is the company that develops the mobility solutions that are affected by this Legal Notice and the Conditions of Use.

2. Purpose and scope of application
   
   

   These conditions regulate the access to the contents and all the services offered by Net4things, as well as the use thereof by the Users (hereinafter, the “Users”). However, Net4things reserves the right to modify the presentation, configuration and content of its services, as well as the conditions required for its access and/or use. The registration and use of the services offered implies the express and unreserved acceptance of all the terms of this Legal Notice, having the same validity and effectiveness as any contract entered into in writing and signed for this purpose.

3. Access to the service
   
   

   Access to the services provided by Net4things is free, although the enjoyment of certain functionalities requires the purchase of telematic devices, subject to prior contracting and payment of an amount, stipulated by the third party that provides said devices. In the event that the service is provided through a smartphone application, the User will have to download the application from the Google Play or App Store stores to activate the service. The User will be informed of the actions to be carried out at all times, and must follow the instructions provided and accept these Conditions:

   1. Register as a new User: to do this, you must enter your email as Username and validate it with a PIN that you will receive by email.
   2. Scan the QR code of the telematics device if you want to enjoy the functionalities they unblock. It is necessary for the User who has purchased a compatible telematics device from a third party to follow the latter’s instructions to complete its activation.
   3. Afterwards, the User will have the option of being able to fill in optional information in the application that will serve to personalize the experience of using the service. Without prejudice to other obligations associated with the use of the service, the User will inform the invited Users about the functionalities of the service and the sharing of information related to its use.
4. Intellectual and industrial property
   
   

   Net4things is the owner and holds all the necessary authorizations for the exploitation of all the intellectual and industrial property rights associated with its services. Any exploitation of an element that is included within the Services, whether for profit or not, must have the express and prior authorization of Net4things or, where appropriate, its legitimate rights holder. Net4things respects all intellectual and industrial property rights of third parties. If at any time you understand that your rights are being infringed by us, please contact us at soporte@net4things.com and we will analyze the case.

5. Description of the Service
   
   

   Net4things offers the following functionalities in the service:

   • Manage any device
     

     Setting up and seeing all your assets together, in a way that makes sense to you, has never been easier! Take advantage of our newly developed asset dashboard to add a device or manage your existing ones. The unified view allows you to control all your assets at a glance!

   • Control your asset
     

     The service identifies which type of asset you are controlling and seamlessly adapts the view to serve the right content. Manage the error codes, get repair quotations upon request, or configure your WiFi settings if you are connecting to a car. If you are watching after your pet, configure which push notifications will be sent based on movements, or schedule an appointment with your preferred veterinary clinic.

   • Each user, a different view
     

     Use only the widgets that are relevant to you, sort them as you wish, and hide the rest to create a personalized view of your assets. Everything in order and accessible.

   • Locate your assets
     

     The service tracks all assets via GPS and can guide you to them using your phone’s location services.
     You can see all your assets and your own location on the map see where everything is.
     The status of each asset is shown (stopped, disconnected, or moving), as well as its exact location, so that you can navigate to them.

   • Keep records in the logbook
     

     The service organizes and recreates your assets’ trips so that you can see the time elapsed, the exact route, and more.
     See weekly, monthly, and yearly usage stats for better understanding of the data.

   • Tag your trips
     

     Be more efficient by tagging your trips and filtering searches in your trip history.
     Let users customize their own tags or predefine them with just one click.
     Get a log of every trip taken with your device, and easily tag and export a list of business trips, holidays, pet walk, etc.

   • Manage your profile
     

     Control your personal information and add a custom profile picture to make the application yours.
     Store all the essential documentation, from your ID to your driver’s license.
     Find help in the frequently asked questions, manage your privacy settings, and reach out to support through the app.

   • Privacy is the cornerstone
     

     The service and Net4Things’ Consent Management Suite enables customized and transparent data sharing options.
     Let users take control of the data they share, with the option to grant or revoke access for specific services at any time.
     All consent information displayed to the user is stored for easy tracking and consulting.

   • Make the most of your mobility data
     

     The service, in combination with the Data Marketing Suite, transforms a promotion into a service by leveraging your mobility data.
     Through a simple, intuitive interface, you can see the list of promotions available to you.
     You can access the details, codes, or coupons associated with each offer, see the list of spots where you can redeem them, and navigate to whichever one you’d like!

6. Correct use of the service
   
   

   Users undertake to use the Service in accordance with the law, morality, generally accepted good customs and public order, as well as to refrain from using the Service and/or other services for illegal purposes or effects, prohibited in these Conditions, harmful to the rights and interests of third parties, or that in any way may damage, disable, overload or deteriorate the services, the computer equipment of other Users or other Internet Users (hardware and software) as well as the documents , files and all kinds of content stored on their computer equipment (hacking), or prevent the normal use or enjoyment of said Services, computer equipment and documents, files and content by other Users and other Internet Users. Net4things does not guarantee the use, or permanent use of the Service, given that its quality and availability may be affected by multiple factors unrelated to Net4things, such as, among others, the geographic location of the Users and the vehicle and consequently, limitations or restrictions of the coverage of telecommunications networks or the compatibility of the device and operating system used by it.

7. Correct use of the contents
   
   

   Users undertake to make diligent, correct use and in accordance with the law, morality and generally accepted good customs and public order of any content obtained through the Service. In particular, they undertake to refrain from (a) reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying the contents, unless they have the authorization of the owner of the corresponding rights or it is legally permitted; (b) delete, evade or manipulate the “copyright” and other data identifying the rights of the owners incorporated into the content, as well as the technical protection devices, fingerprints or any information mechanisms that the content may contain; (c) use the contents in a manner or with effects contrary to the law, morality and generally accepted good customs or public order. Net4things will not be responsible for the infringements of any User that affect the rights of third parties, including copyright, trademarks, patents, confidential information and any other intellectual or industrial property right or of another type. In case of fraudulent or unauthorized use of the Service by third parties, Net4things will not assume any responsibility, expense or cost. Users will be solely and exclusively responsible for any damages that may be caused by breach of current legislation, or the obligations assumed under these Conditions. Users will protect and hold Net4things harmless against any judicial or extrajudicial claim related to breaches on their part, as well as any expense, damage, charge or obligation caused by such breaches.

8. Termination of service
   
   

   The User may unsubscribe at any time through the apps or webapps that are part of the services offered by Net4things. Likewise, Net4things may automatically and immediately terminate a User’s Service, without this breaching any obligation acquired by Net4things.
